These Terms of Service ("Terms") govern your use of Atomic, our terminal-based command-line application, and any associated backend services, updates, and documentation (together, our "Services"). These Terms are a contract between you and Bastani Inc. ("Bastani," "we," "our," or "us"), and they include our Acceptable Use Policy. By installing, accessing, or using our Services, you agree to these Terms.
Please read our Privacy Policy, which describes how we collect and use personal information.
Our Commercial Terms of Service govern your use of any Bastani API key or any other Bastani offerings that reference the Commercial Terms of Service. For clarity, these Consumer Terms apply to individual consumer use of our Services.
Bastani Inc. is a technology company that builds developer tools for AI-assisted software engineering. Our flagship product, Atomic, is a terminal user interface (TUI) application that provides a unified interface to multiple AI coding agent backends, enabling developers to research codebases, generate specifications, implement features autonomously, and manage source control workflows from the command line.
You must be at least 18 years old or the minimum age required to consent to use the Services in your location, whichever is higher.
To access certain features of our Services, we may ask you to create an account. You agree to provide correct, current, and complete account information and allow us to use it to communicate with you about our Services.
You may not share your account login information or credentials with anyone else. You are responsible for all activity occurring under your account, and you agree to notify us immediately at stealthbastani@gmail.com if you become aware of any unauthorized access.
You may close your account at any time by contacting us at stealthbastani@gmail.com.
If you use an email address owned by your employer, your account may be linked to the organization's enterprise account. The organization's administrator may be able to monitor and control the account, including having access to Materials. We will provide notice before linking your account to an enterprise account unless the organization is responsible for notifying you.
You may access and use our Services only in compliance with these Terms, including our Acceptable Use Policy, and any guidelines we may publish. You are responsible for all activity under your account.
You may not access or use, or help another person to access or use, our Services in the following ways:
You also must not abuse, harm, interfere with, or disrupt our Services or backend infrastructure, including by introducing viruses or malware, or conducting denial-of-service attacks.
You may interact with our Services by submitting content such as prompts, commands, and code references ("Inputs"). Our Services may generate responses such as code, text, specifications, and analysis ("Outputs"), or take actions on your behalf such as file creation, code modification, git operations, and system interactions ("Actions"). Inputs and Outputs collectively are "Materials."
You are responsible for all Inputs you submit and all Actions taken by the Services on your behalf, including autonomous actions performed by features such as Ralph. By submitting Inputs, you represent and warrant that you have all rights, licenses, and permissions necessary for us to process the Inputs and provide the Services to you. As between you and Bastani, and to the extent permitted by applicable law, you retain any right, title, and interest that you have in the Inputs you submit. Subject to your compliance with these Terms, we assign to you all of our right, title, and interest (if any) in Outputs.
Atomic operates on your local machine and may read, create, modify, or delete files; execute terminal commands; and interact with your local development environment. You acknowledge that you are responsible for reviewing and approving Actions that affect your local system, source code repositories, and any connected services. We strongly recommend using version control and reviewing changes before committing or deploying code generated by the Services.
AI technology is still improving in accuracy, reliability, and safety. When you use our Services, you acknowledge and agree:
We may use Materials to provide, maintain, and improve the Services and to develop other products, unless you opt out through your account settings. Even if you opt out, we will use Materials for service improvement when: (1) you provide Feedback regarding any Materials, or (2) your Materials are flagged for safety review.
Our Services integrate with and rely on third-party AI coding agent backends, including but not limited to Claude Code (Anthropic), OpenCode, and GitHub Copilot CLI (Microsoft) ("Third-Party Agent Services"). Your use of these Third-Party Agent Services through Atomic is subject to the respective third party's terms of service, privacy policies, and pricing. You are responsible for maintaining valid accounts and subscriptions with any Third-Party Agent Services you choose to use, and for any costs incurred through those services.
Our Services may also connect to other third-party content, tools, or integrations, including Model Context Protocol (MCP) servers, source control platforms, and other developer tools ("Third-Party Integrations"). We do not control or accept responsibility for any Third-Party Agent Services or Third-Party Integrations. Your use of any such services is at your own risk.
We appreciate feedback, including ideas, suggestions, bug reports, and ratings ("Feedback"). If you rate an Output in response to an Input, we will store the related conversation as part of your Feedback. You have no obligation to give us Feedback, but if you do, you agree that we may use the Feedback however we choose without any obligation or payment to you.
You may be required to pay fees to access certain features of the Services. You are responsible for paying any applicable fees listed for the Services on our pricing page. If you purchase access, you must provide complete and accurate billing information ("Payment Method"). You agree that we may charge the Payment Method for applicable fees and taxes.
Except as expressly provided in these Terms or required by law, all payments are non-refundable.
To access subscription services, you must sign up for a subscription ("Subscription"). Your Subscription will automatically renew and your Payment Method will be charged at the end of each term until you cancel.
You may cancel your Subscription at any time through your account settings or by contacting us at stealthbastani@gmail.com. To avoid renewal charges, cancel at least 24 hours before the end of your current term. Upon cancellation, your access continues through the end of the current paid term; fees are not refunded.
If you are a resident of a jurisdiction that provides a legal cooling-off period, you have the right to cancel within the applicable period (e.g., 7 days) without giving a reason. If you cancel during this period, we will reimburse all payments received for the cancelled Subscription within 14 days using the same payment method. If you used the Services during the cooling-off period, we may retain a proportional amount.
We may release updates, patches, or new versions of Atomic ("Updates") at any time. Updates may be delivered manually via our installation scripts, package managers, or the built-in atomic update command. Atomic includes open-source software components, which are governed by the applicable open-source license terms. Our proprietary backend services and any proprietary components remain subject to these Terms.
The Services are owned, operated, and provided by us and our affiliates, licensors, distributors, and service providers (collectively "Providers"). We and our Providers retain all rights, title, and interest, including intellectual property rights, in and to the proprietary components of the Services and our backend infrastructure. The Atomic open-source codebase is licensed under its applicable open-source license. Other than the rights expressly granted in these Terms and the applicable open-source license, these Terms do not grant you any additional right, title, or interest in our Services.
YOUR USE OF THE SERVICES, MATERIALS, AND ACTIONS IS SOLELY AT YOUR OWN RISK. THE SERVICES, OUTPUTS, AND ACTIONS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS AND, TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, ARE PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE AND OUR PROVIDERS EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, TITLE, MERCHANTABILITY, ACCURACY, AVAILABILITY, RELIABILITY, SECURITY, PRIVACY, COMPATIBILITY, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT ANY CODE, SPECIFICATIONS, OR OTHER OUTPUTS GENERATED BY THE SERVICES WILL BE FREE OF BUGS, ERRORS, OR SECURITY VULNERABILITIES, OR THAT AUTONOMOUS ACTIONS WILL OPERATE AS INTENDED.
TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, IN NO EVENT WILL BASTANI, OUR PROVIDERS, OR OUR OR THEIR RESPECTIVE AFFILIATES, INVESTORS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR ASSIGNS (COLLECTIVELY, THE "BASTANI PARTIES"), BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR OTHER DAMAGES ARISING OUT OF OR IN ANY WAY RELATED TO THE SERVICES, MATERIALS, ACTIONS, OR THESE TERMS, INCLUDING BUT NOT LIMITED TO DAMAGES RESULTING FROM CODE GENERATED OR MODIFIED BY THE SERVICES, LOSS OF DATA, OR UNINTENDED SYSTEM CHANGES.
TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, THE BASTANI PARTIES' TOTAL AGGREGATE LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO US FOR THE SERVICES IN THE SIX MONTHS PRECEDING THE DATE SUCH DAMAGES FIRST AROSE, AND $100.
YOU AGREE TO INDEMNIFY AND HOLD HARMLESS THE BASTANI PARTIES FROM AND AGAINST ANY AND ALL LIABILITIES, CLAIMS, DAMAGES, EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES), AND OTHER LOSSES ARISING OUT OF OR RELATED TO YOUR BREACH OF THESE TERMS; YOUR USE OF THE SERVICES, MATERIALS, OR ACTIONS; YOUR FEEDBACK; ANY PRODUCTS, CODE, OR SERVICES YOU DEVELOP, DEPLOY, OR DISTRIBUTE IN CONNECTION WITH THE SERVICES; YOUR VIOLATION OF LAW OR THIRD-PARTY RIGHTS; AND ANY FRAUD, MISCONDUCT, OR CRIMINAL ACTS BY YOU.
THE LAWS OF SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES OR CERTAIN TYPES OF DAMAGES, SO SOME OR ALL OF THE ABOVE MAY NOT APPLY TO YOU.
We reserve the right to modify, suspend, or discontinue the Services or your access, in whole or in part, at any time without notice. We will strive to provide reasonable advance notice where feasible.
We may revise and update these Terms at our discretion. If you continue to access the Services after we post updated Terms, you agree to the updated Terms. If you do not accept updated Terms, you must stop using the Services.
These Terms and any other terms expressly incorporated by reference form the entire agreement between you and us regarding the subject matter of these Terms.
You may stop using the Services at any time and may uninstall Atomic using the atomic uninstall command. We may suspend or terminate your access to our backend services without notice if we believe you have breached these Terms or if required by law. If we terminate your access due to a violation, you will not be entitled to a refund. We may also terminate your account if it has been inactive for over a year.
Upon termination, we may delete any Materials or data associated with your account. Sections 7 (regarding outstanding fees), 8, 9, 10, and 11 survive termination.
If any provision of these Terms is found to be invalid or unenforceable, it will have no effect on the remaining provisions.
Any delay or failure to enforce a provision is not a waiver of our right to enforce it later.
You may not transfer or assign these Terms without our prior written consent. We may assign without restriction.
You may not use our name, logos, or trademarks without our prior written permission.
You may not export or provide access to the Services into any U.S. embargoed countries or to any restricted persons or entities under applicable sanctions and export control laws.
You agree that no adequate remedy exists at law if you breach Section 3 (Use of Our Services), and that a grant of injunctive relief provides the best remedy for any such breach. You waive any opposition to such relief.
These Terms will be governed by and construed in accordance with the laws of the State of Delaware without giving effect to conflict of law principles. You and Bastani agree that any disputes arising from these Terms will be resolved exclusively in the state or federal courts located in Wilmington, Delaware, and you submit to the personal and exclusive jurisdiction of those courts.
